SERVICE POLICY, PRIVACY NOTICE, AND REGULATIONS OF HOTEL PALMAS DE CORTEZ.
By using the digital platforms operated by "Hotel Palmas de Cortez Los Barriles," S.A. and/or by contracting the lodging services offered by it, full and express consent is presumed from the user or guest to observe and adhere to each of the terms and conditions contained herein, as well as to the payment, privacy, security, and conduct policies.
DENOMINATIONS IN THE HOTEL
It will be understood in two main ways in this document:
A1) The legal entity "Hotel Palmas de Cortez Los Barriles," S.A., operating under the commercial name "Hotel Palmas de Cortez."
A2) The facilities located at 20 de Noviembre Street, number 2, between Valentín Ruiz and Camino Real, Los Barriles, La Paz, Baja California Sur.
THE SITE: Refers to the official website of the HOTEL, as well as any related applications or platforms, encompassing all forms of interaction that the HOTEL may offer to its users and potential guests in the digital realm.
USER: Defined as any person accessing the official website of the HOTEL or its digital applications.
GUESTS: The individuals who stay at the HOTEL's facilities, whether individual clients or groups that have booked rooms or spaces for their stay.
CONFIDENTIAL INFORMATION/DATA: Refers to any information related to an identified or identifiable natural or legal person.
DATA CONTROLLER: "Hotel Palmas de Cortez Los Barriles," S.A., as a private entity that decides on the processing of personal data.
THIRD PARTY: Defined as any natural or legal person, national or foreign, other than the data subject or the data controller, such as affiliates, clients, and suppliers, among others.
TRANSFER: Refers to any communication of data made to a person other than the data controller or data processor.
DATA SUBJECT: The natural or legal person to whom the data belongs.
PROCESSING: Understood as the obtaining, use, disclosure, or storage of data by any means. Processing includes any action of access, handling, utilizing, transferring, or disposing of data.
RESERVATIONS, LODGING, GUARANTEES, CANCELLATIONS, AND NO-SHOWS
Rates and Occupancy: Children up to 12 years old are complimentary. If requesting a rate for 2 adults, and a third person arrives, there will be an additional charge, which must be quoted and paid at the hotel upon check-in. The rates published on the site are valued per night of stay. Those identified as promotional or special rates are valid only when booked under the terms and conditions stipulated by the promotion. All rates include VAT and tourist taxes, as well as governmental taxes, and if services are acquired in foreign currency, payments will be settled in the national currency equivalent (Mexican pesos), at the exchange rate applicable on the date and place of payment. This exchange rate will be determined according to the provisions issued by the Bank of Mexico in accordance with its Organic Law. Details of accommodation rates are correct at the time of publication and are subject to change without prior notice.
Guaranteed Reservations: Reservations are guaranteed only when the client provides valid credit or debit card details (card number, expiration date, security code, and cardholder) and has proceeded with the payment of 25% of the reservation. Otherwise, until a bank deposit/transfer for the value of 25% of the reservation has been completed. If there are insufficient funds or the card details are incorrect, the reservation will be canceled. Once your reservation has been successfully completed, a reservation confirmation will be issued referencing each reserved room and sent to the email address provided in your reservation. You must present the reservation confirmation(s) at check-in, along with your original and valid photo identification (passport for foreigners, or voter ID, driver's license, professional ID, or military service ID). At all times during the reservation process, you will be encouraged to ensure the accuracy of your reservation details (guest details, stay dates, room types, room rates, number of guests, add-ons). The hotel will not be responsible for errors in the reservation details.
Cancellations: The guest may cancel their reservation within three days following the booking to receive a 100% refund of the deposit. If the cancellation is made after this period, the total deposit will be charged, and the corresponding invoice will be issued. Cancellations must be requested via email or phone directly to the hotel.
Reservation Modifications: Reservation modifications can be made up to fifteen days before the stay, and rates will be recalculated according to the new date and type of room chosen. The final cost cannot be less than that of the original reservation. In case of no-show, the total reservation amount will be charged, and the corresponding digital tax receipt will be issued.
CHECK-IN / CHECK-OUT
Check-in: The room is available for use starting at 3:00 PM on the day of arrival. If the guest wishes to access their room before this time, they must contact the reservations department or directly the hotel to inquire about the additional cost for early check-in services.
Check-out: The deadline for vacating the room on the day of departure is 12:00 PM. If the guest stays longer, a charge for an additional night will be applied, with a grace period of 30 minutes.
Registration and Security: All guests and their visitors must be registered at the reception in strict compliance with the terms and conditions established by the Hotel regarding the privacy and security of all clients.
Room Inspection: Check-out will be conducted in the presence of a hotel staff member authorized for this purpose, to verify or remedy any damages caused to the furniture or property. The corresponding charges will be made once the check-out is finalized.
VISITORS:
The hotel reserves the right to admit visitors and/or occasional companions to the facilities, depending on the discretion of the staff on duty. Under no circumstances will access to the rooms be allowed, for security and health reasons, both for the client and the hotel and its staff.
RESPONSIBILITY:
The hotel will only be responsible for valuables or belongings that are consigned for safekeeping in the safes supervised by the reception staff. Therefore, it will not be responsible for loss, damage, deterioration, impairment, loss, or similar issues regarding valuables or belongings not consigned that belong to the guests. The hotel is not responsible for partial or total loss of vehicles left in the parking area.
CONDUCT
It is strictly prohibited for the guest and/or their visitors to perform the actions and omissions listed below within the hotel facilities:
Not allowed to consume external food and beverages in common areas; if brought in, they are only for consumption in the room.
Making noise, provoking disturbances, bringing animals without prior authorization, drugs, chemicals, and generally any act that disturbs or inconveniences other guests.
Using the rooms for acts prohibited by law or holding meetings aimed at disturbing public order or disobeying current laws or regulations.
Irrationally or for other purposes using electricity, water, goods, and objects from the rooms and common areas of the hotel.
Using candles, dangerous or flammable materials in the rooms.
Bringing pets into the hotel or rooms.
Removing hotel property, linens, furnishings, and/or similar items from the hotel facilities.
Causing any damage to the hotel property such as walls, furniture, decorations, towels, sheets, or any other item that does not belong to the guest.Smoking in rooms or closed spaces of the hotel.
SANCTIONS
In accordance with the General Law for Tobacco Control, smoking is not allowed in rooms or closed spaces of the hotel. Doing so will result in a fine, as this causes deterioration to the facilities; therefore, a 100% charge of the average cost of one night’s stay will be applied for additional cleaning for each incident.It is specified that damage or loss of the hotel’s property will incur a penalty equivalent to the total cost of the damaged item. The list containing the corresponding costs is available in the hotel reception area and can be requested from the staff on duty.
CONFIDENTIALITY AND PRIVACY
The entity "Hotel Palmas de Cortez Los Barriles," S.A., located at 20 de Noviembre Street, number 2, between Valentín Ruiz and Camino Real, Los Barriles, La Paz, Baja California Sur; as well as with the email info@vanwormerresorts.com and phone number 01 800 836 2737 / 877 777 8862. It states through this section that it acts as the obligated subject and responsible for the processing of personal data requested and/or provided by GUESTS, USERS, and/or clients (data subjects), whether provided by them, their representatives, managers, booking platforms, or any other third party; such DATA will be protected in accordance with applicable regulations and will be processed under its responsibility, according to legal powers and this privacy notice. The personal data collected from the Data Subject will include: a) Identification data; b)Contact data; c) Employment data; and d) Asset or financial data, which will be used for the purpose of verifying: a) The feasibility of lodging; b) making charges related to reservations, changes in reservations required by the Data Subjects, expenses arising from damages or impairments for which the Data Subjects are responsible and/or fines related to their conduct; c) Sending promotions and information related to the goods or services marketed by the HOTEL; and d) to integrate their personal file and verify their identity. Information regarding the Data Subject will be treated with strict adherence to confidentiality; under no circumstances will it be shared with third parties without the explicit consent of the data subject, except when required by legal or judicial mandate. The information collected by the HOTEL to provide better service may include:
Names and surnames.
Type and number of identification.
Nationality and country of residence.
Date of birth and gender.
Marital status and/or relationship to minors or disabled persons requesting our services.
Fixed and mobile contact numbers (personal and/or work).
Postal and email addresses (personal and/or work).
Profession or trade.
Company where they work and position.
Origin and destination.
Reason for their trip.
Information from debit or credit card(s) (number, banking entity, expiration date).
Personal data of the cardholder (names and surnames, type and number of identification).
THE DATA CONTROLLER will process the aforementioned personal data strictly in accordance with the provisions of the second paragraph of Article 16 of the Political Constitution of the United Mexican States, in conjunction with the provisions of Articles 1, 6, 7, and 8 of the Federal Law on the Protection of Personal Data Held by Private Parties, for which reason this Privacy Notice is made available to you.The Data Subject may exercise their ARCO rights (Access, Rectification, Cancellation, and Opposition) personally at the offices of the DATA CONTROLLER; that is, those located at 20 de Noviembre Street, number 2, between Valentín Ruiz and Camino Real, Los Barriles, La Paz, Baja California Sur, or by email sent to info@vanwormerresorts.com. Consequently, the DATA SUBJECT, by using the digital platforms operated by the DATA CONTROLLER and/or contracting the lodging services offered by the same, grants their tacit consent for the processing of their personal data.The DATA CONTROLLER will not carry out transfers of personal data, unless required by a duly substantiated and motivated legal or judicial mandate.In the event of modifications to this Privacy Notice, you will be notified promptly through relevant electronic, written, or visual means.
USE OF THE POOL
The Hotel complies with all safety regulations established by Civil Protection to ensure the safety of our guests. We appreciate our clients' cooperation in adhering to these regulations, as by using our pool facilities, they accept and commit to comply with the following terms and conditions.
Exclusive Use: The pool is exclusively for the use of hotel guests and authorized guests.
Dress Code: Swimwear is mandatory for both children and adults. Children under 12 must be accompanied by a responsible adult at all times in the pool area.
Client Responsibility: Access to the pool, for both children and adults, is the client's responsibility. It is noted that there are no lifeguards on our premises
Prohibitions of Use:
No entry to the pool with underwear, t-shirts, shorts, or any natural fiber clothing.
Entry with sunscreen and/or oils is prohibited.
It is strictly prohibited to bring any type of food and/or beverages, as well as glass bottles.
Smoking and the entry with chewing gum are prohibited in the pool area.
Rough play is prohibited in the pool facilities for safety reasons.
For hygiene, health, and safety reasons, the access of any type of pet to the pool area is strictly prohibited. This provision aims to ensure a clean, safe, and risk-free environment for all users.
Personal Responsibility: The hotel is not responsible for accidents, injuries, or loss of personal property inside or around the pool. All users use the pool at their own risk.
Failure to comply with these terms and conditions may result in denial of access to the pool in order to prioritize the safety of our guests.
SPORTFISHING
Reservations: Reservations for the sportfishing service must be made in advance through the HOTEL's official website, its digital applications, or directly at its physical facilities.
Reservation Confirmation: To confirm a reservation, payment of 100% of the agreed price for the service at the time of booking is essential. This payment may be made via credit card, debit, or bank transfer. Compliance with this condition is indispensable for formalizing the service contract.
Reservation Receipt: Once payment is made, the client will receive a confirmation of their reservation at the authorized email address for that purpose, which must be presented on the day of service as valid proof.
Cancellation and Refund Policy: The client may cancel their reservation and receive a 100% refund of the payment made if the cancellation is made within three immediate days following the date of the reservation. Cancellations must be requested in writing and sent to the HOTEL's contact email.
After the three mentioned days, no refunds will be made, regardless of the reason for cancellation. If the client does not show up on the reserved date and time for the sportfishing service, it will be considered a "No Show," and the paid amount will not be refunded.
Client Punctuality: The client must arrive punctually at the indicated place and time for the departure of the sportfishing service, with a recommendation to arrive at least 30 minutes early
Responsibility and Safety Rules: It is the client's responsibility to comply with all instructions and safety rules provided by the HOTEL staff and the sportfishing service. By contracting said service, consumers acknowledge and accept the inherent risks of participating in such recreational activities and using associated tools. The HOTEL is not responsible for any accident or injury that may occur during the use of the tools and/or services provided. Consequently, users assume full responsibility for their safety and well-being.
Exclusion of Liability: The client agrees that the HOTEL is not responsible for any injury, loss, or damage to personal property that may occur during participation in the sportfishing service.
Weather and Safety Conditions: The sportfishing service is subject to weather and safety conditions. The HOTEL reserves the right to cancel or reschedule the service in case of adverse conditions, ensuring the safety of the participants. In the event of a fortuitous event or force majeure that prevents the provision of the sportfishing service, the HOTEL will reschedule the service on dates determined by the client but will not issue refunds.
Client Information: The client must provide truthful and complete information at the time of booking, including contact details and any relevant medical condition that may affect their participation in the sportfishing service.
Safety Equipment and Instructions: The client must use the safety equipment provided and follow all instructions from the staff during the sportfishing service.
DOG-FRIENDLY ROOMS
Availability and Reservations: Our hotel offers dog-friendly rooms for guests who wish to travel with their canine pets. These rooms are subject to availability and must be booked in advance. An additional fee per night per pet will apply, which must be paid at check-in.
Requirements and Restrictions: To ensure a comfortable and safe stay for all of our guests, the following policies apply to dog-friendly rooms:
A maximum of two pets are allowed per room.
Pets must be up to date with their vaccinations and health certificates, which can be requested at check-in.
Pets must be supervised at all times and are not allowed to be left alone in the room.
Guest Responsibility: Guests are responsible for any damage caused by their pets to hotel property or other guests. An additional fee will be charged for cleaning if necessary, adhering to the provisions of point 6.9.B) of this instrument.
Designated Areas for Pets: The hotel has designated areas for pets to walk and play. Guests must pick up after their pets and keep the areas clean.
Prohibitions: Pets are not allowed to enter the pool areas, restaurants or any other area where their access is not permitted for health and safety reasons.
RIGHT OF ADMISSION
The hotel, with the intention of prioritizing the safety of our guests, users and/or clients, reserves the right of admission in the following cases:
Protocols established by the Government: Municipal, State and/or Federal.
Sobriety.
Aggressiveness and/or hostility.
Risky behavior for hotel employees, guests, visitors and/or diners.
No person will be discriminated against, excluded, distinguished or denied access on the basis of national origin, language, sex, gender, age, disability, social status, indigenous identity, gender identity, physical appearance, health conditions, religion, ways of thinking, sexual orientation or preference, tattoos or any other reason.
PRODUCTS AND IMAGES
All images of the products shown on the menu and on the hotel's website are the exclusive property of the company, and have been taken of the dishes and drinks at the time of their preparation and service. The company reserves all rights to their use, including the reproduction, distribution and public communication of said images. The preparation of the dishes is artisanal; therefore, there may be slight variations in the appearance of the dishes served compared to the images shown. These variations are normal and reflect the unique character of each individual preparation, without prejudice to the above, a constant effort is made to maintain the highest quality and consistency in the presentation of all products.
SALE OF ALCOHOL
The Restaurants of the Hotel Palmas de Cortes strictly comply with current legislation on the sale of alcohol to minors, so the sale of alcoholic beverages to minors is prohibited. This policy is implemented to ensure compliance with legal regulations and encourage responsible alcohol consumption among our guests. The company is not responsible for any damage caused by improper acts of consumers under the influence of alcohol. In addition, it does not assume any responsibility for illnesses resulting from the consumption of these products. Customers are responsible for their own actions and the consequences that may arise from their improper use. It is important to remember that alcohol and tobacco consumption must be carried out responsibly and with awareness of the associated risks. All guests and visitors are advised to avoid behavior that may put their health and that of others at risk, and to respect the regulations established to ensure harmonious and safe coexistence within our facilities.
